Welcome to Lovistry. These Terms of Service ("Terms") govern your use of the Lovistry mobile application ("App" or "Service"). By using Lovistry, you agree to these Terms. If you do not agree, please do not use the App.
1. Description of Service
Lovistry is a mobile application that allows users to archive handwritten cards and notes, extract text using optical character recognition (OCR), store important relationship dates, organize messages by occasion and date, and receive AI-powered assistance in composing new messages.
2. Eligibility
You must be at least 13 years old to use Lovistry. By using the App, you represent that you meet this age requirement. If you are under 18, you represent that you have your parent or guardian's permission to use the Service.
3. Account Registration
An account is required to use Lovistry. You agree to provide accurate information and keep your login credentials secure. You are responsible for all activity that occurs under your account. Notify us immediately if you suspect unauthorized access to your account.
4. Free and Subscription Plans
Free Plan
Lovistry offers a free plan with access to core features. The free plan includes advertisements. By using the free plan, you consent to the display of ads within the App.
Subscription Plan
Lovistry offers a paid subscription that provides access to additional features and an ad-free experience. Subscription fees are billed in advance on a recurring basis through the Apple App Store or Google Play Store. Pricing and billing frequency will be displayed before purchase.
Cancellation and Refunds
You may cancel your subscription at any time through your app store account settings. Upon cancellation, you will retain access to subscription features until the end of your current billing period. Refunds are handled according to the policies of the Apple App Store or Google Play Store.
Price Changes
We may change subscription prices from time to time. Price changes will be communicated in advance and will apply to your next billing cycle after notice is given.
5. Your Content
Ownership
You retain ownership of all content you submit to Lovistry, including messages, photos, important dates, and any other materials ("Your Content"). We do not claim ownership of Your Content.
License to Us
By submitting content to Lovistry, you grant us a limited license to store, process, display, and analyze Your Content solely to provide and improve the Service. This includes using Your Content to power the AI assistant features. This license ends when you delete Your Content or your account.
Your Responsibilities
You are responsible for Your Content. You represent that you have the right to submit any content you upload and that Your Content does not violate any law or third-party rights.
6. Acceptable Use
You agree not to:

- —Upload content that is illegal, harmful, threatening, abusive, or otherwise objectionable
- —Attempt to gain unauthorized access to the Service or other users' accounts
- —Interfere with or disrupt the Service or servers
- —Reverse engineer, decompile, or attempt to extract the source code of the App
- —Use the Service to spam or harass others
- —Use automated means to access the Service without our permission
- —Circumvent, disable, or interfere with advertisements displayed in the free version
7. AI-Generated Content
Lovistry provides AI-powered message suggestions based on your saved content. These suggestions are provided as inspiration and assistance only. You are responsible for reviewing, editing, and approving any AI-generated content before use. We do not guarantee that AI suggestions will be appropriate for any particular situation.
8. Intellectual Property
The Lovistry App, including its design, features, and underlying technology, is owned by us and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or other brand features.
9. Disclaimer of Warranties
Lovistry is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or secure. We disclaim all warranties including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant the accuracy of OCR text extraction or AI-generated suggestions.
10. Limitation of Liability
To the maximum extent permitted by law, Lovistry and its owners, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim, or $100, whichever is greater.
11. Indemnification
You agree to indemnify and hold harmless Lovistry and its owners, officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.
12. Termination
You may stop using Lovistry and delete your account at any time. We may suspend or terminate your access to the Service at our discretion, including for violation of these Terms. Upon termination, your right to use the Service ceases immediately and any active subscription will not be refunded for the current billing period. Sections that by their nature should survive termination will survive.
13. Changes to Terms
We may modify these Terms at any time. We will notify you of material changes through the App or by email. Your continued use of Lovistry after changes take effect constitutes acceptance of the revised Terms. If you do not agree to the changes, you must stop using the Service.
14. Governing Law and Disputes
These Terms are governed by the laws of the State of South Dakota without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Service shall be resolved in the state or federal courts located in South Dakota, and you consent to the personal jurisdiction of such courts.
15. General Provisions
These Terms constitute the entire agreement between you and Lovistry regarding the Service. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce any right or provision does not constitute a waiver. You may not assign or transfer these Terms without our consent.
